Terms of Service

These Terms of Service ("Terms") govern your access to and use of debtfreegenius.com and start.debtfreegenius.com (together, the "Site"), operated by Debt Free Genius ("we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. What Debt Free Genius is (and is not)
Debt Free Genius is a marketing and consumer-connection service. We provide general educational information about debt relief options and connect consumers with independent third-party debt relief providers ("Providers").
We are not a lender, creditor, debt collector, debt settlement company, credit counseling agency, credit repair organization, financial advisor, accountant, or law firm. Nothing on the Site constitutes financial, legal, tax, or accounting advice. You should consult qualified professionals before making decisions about your debts.
2. Eligibility
The Site is intended for use by individuals who are at least 18 years old and located in the United States. By using the Site, you represent that you meet these requirements. Services may not be available in all states.
3. How the service works
When you complete our questionnaire, we use your responses to identify debt relief options that may fit your situation and to connect you with one or more Providers. Providers are independent businesses. Any program, product, or service you obtain from a Provider is governed solely by that Provider's own terms, agreements, and disclosures. We are not a party to any agreement between you and a Provider.
4. Compensation disclosure
We may receive compensation from Providers when we connect consumers with them. This compensation is how we keep the Site free for consumers. The Providers we work with, and the order or manner in which they are presented, may be influenced by this compensation.
5. No guarantees
We do not guarantee that you will qualify for any program, that any Provider will accept you as a client, that your debts will be reduced by any specific amount or percentage, or that you will become debt free within any specific period of time. Individual results vary based on many factors, including your specific debts, creditors, and ability to complete a program. Debt relief programs can have significant consequences, including negative effects on your creditworthiness, continued collection activity or lawsuits by creditors, and growth of enrolled balances due to accrued fees and interest. Read and understand all Provider program materials before enrolling.
6. Consent to be contacted
By submitting your contact information through the Site and agreeing to the consent language presented at the time of submission, you consent to be contacted by Debt Free Genius and its partner Providers by phone, email, and text message, including through automated technology, at the contact information you provided. Consent is not a condition of purchase. You may opt out at any time as described in our Privacy Policy.
7. Your responsibilities
You agree to provide accurate, current information when using the Site, and to use the Site only for lawful, personal, non-commercial purposes. You agree not to interfere with the operation of the Site, attempt to access non-public areas or systems, scrape or harvest data, or use the Site to transmit anything unlawful, misleading, or harmful.
8. Intellectual property
The Site and its contents, including text, graphics, logos, and design, are owned by Debt Free Genius or its licensors and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from the Site without our prior written permission, except for personal, non-commercial viewing.
9. Third-party content and links
The Site may reference or link to third-party websites and services, including Provider websites. We do not control and are not responsible for third-party content, products, or services. Your dealings with any third party, including Providers, are solely between you and that third party.
10. Disclaimer of warranties
THE SITE AND OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT INFORMATION ON THE SITE IS COMPLETE, ACCURATE, OR CURRENT.
11. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DEBT FREE GENIUS AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR ANY DEALINGS WITH PROVIDERS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED ONE HUNDRED DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
12. Indemnification
You agree to indemnify and hold harmless Debt Free Genius and its owners, officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.
13. Governing law
These Terms are governed by the laws of the State of Maine, without regard to its conflict of laws principles. Any dispute arising out of these Terms or your use of the Site will be brought in the state or federal courts located in Maine, and you consent to the jurisdiction of those courts.
14. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the effective date above. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
